JACK BABCHIKGraduated with honors from St. John’s University School of law in 1977 with a Juris Doctorate. Admitted to practice in New York, Second Department, in March 1978; United States District Courts for the Southern and Eastern Districts of New York in January 1979; United States Court of Appeals, Second Circuit, in May 1988; United States Supreme Court in October 1989; registered to practice before the United States Patent and Trademark Office since 1978; Certified Mediator, United States District Court for the Northern District of New York. Author of articles for the profession and lecturer on professional liability, toxic torts and construction litigation to professional groups and insurance companies. Over 23 years of experience including trial and appellate practice and has argued before the New York State Court of Appeals. Formerly associated with Kenyon & Kenyon, a patent and trademark litigation firm representing Fortune 500 companies and Hart & Hume, a professional liability and construction litigation firm catering to the insurance industry. In 1983, along with two partners from Hart & Hume, founded the firm of Bergadano, Zichello & Babchik and expanded the firm’s service to include not only professional liability defense, but also products liability, toxic tort, Labor Law, Employment Law and general liability. In 1996, founded Babchik & Mond and established a successful practice geared to the insurance defense industry, professionals and corporate clients. In 1999, the firm name was changed to Babchik & Young, LLP, and continued the practice of its predecessor while incorporating new areas of expertise in Medical Malpractice, Vertical Transportation and General Liability brought about by the addition of Bruce M. Young & Associates. Member of the American Bar Association and the section on Torts and Insurance Practice; New York State Bar Association and the section on Insurance, Negligence and Compensation Law; Westchester County Bar Association; and the Professional Liability Underwriting Society (PLUS). BRUCE M. YOUNGGraduated from New York Law School in 1984 after having successfully completed a 6 year B.A.- J.D. program in conjunction with The City College of The City of New York, Max Greenberg Honors Program, B.A. Cum Laude 1981. Admitted to practice in 1985 in New York, New Jersey & Washington D.C.; United States Court of Appeals for the Second Circuit; United States District Courts for the Southern and Eastern Districts of New York and The District of New Jersey. Previously a member of the firm of Kanterman & Taub, P.C., concentrating in the defense of medical malpractice and product liability cases. Became a partner in 1990 at the age of 29 and served as trial counsel to major New York City hospitals including Presbyterian Hospital in the City of New York, New York Medical College, and Westchester County Medical Center. In addition, represented the interests of The New York City Housing Authority and The Hilton Hotels chain in breach of security cases involving major felonies. Mr. Young maintains a significant products liability defense practice, and is Regional Counsel to ThyssenKrupp and Dover Corporation, a Fortune 100 Company. Dover Elevators, etal. - Supreme Court, Bronx County-1 ˝ week trial. $210,000 Plaintiffs Verdict (6/98) in elevator accident (30% against Dover, 50% codefendant, 20% plaintiff) now on appeal. 3. Moog v. Waldorf-Astoria and Hilton – USDC Southern District of New York- 2 week trial. Defense Verdict (12/96) Action by German National for breach of security and claimed interference with first party insurance issued by German carrier stemming from theft of $750,000 (documented) in Jewelry. Case also involved practice under the Hague Convention. 4. Ray v. Hardy – Supreme Court, New York County – 2 ˝ week trial. Defense Verdict (2/94) in Medical Malpractice action. Represented transplant surgeon in action alleging paralysis secondary to iatrogenic injury status-post kidney transplant. Plaintiff discontinued against hospital after jury selection. 5. Ippolito v Westchester - Supreme Court, Westchester County - 1˝ week trial. Defense Verdict. Negligent roadway design and maintenance action by female passenger injured/disfigured in MVA. 6. Manniello v Con Edison and Combustion Engineering – Supreme Court, New York County. 7-day trial. Defense Verdict. Labor Law 240/241(6) action by CE employee alleging back injury and permanent disability against prop owner (Con Ed) and CE for negligent supervision. 7. Dimico v Dover – Supreme Court, Suffolk County, 4 day trial. Directed Verdict. Elevator Misleveling Case. 8. Atlantic Mutual Insurance v. Woolworth – Supreme Court, New York County 5-Day Trial. Defense Verdict. Elevator Misleveling Case. 9. Medina v NY Elevator - Supreme Court, New York County- Index # 122100/99-10 day trial- Freight elevator crash resulting in severe injury to stage hand at NY Opera. Defense Verdict. Settled post-verdict 200k. 10. Reis v. NY Elevator - October 2002, Supreme Court, Kings County-5 day trial- Index # 1553/90-Door strike case, Plaintiff verdict $97,500. Post-trial appeal to set aside verdict granted and case dismissed. Plaintiff claimed to have sustained fractured right metacarpals requiring surgical repair secondary to an alleged door strike by an inadequately protected door that exceeded the A17.1 code requirements for kinetic energy. Reversed on Appeal and case dismissed with prejudice. 11. Cardona v. NYE - 10 day trial S/Queens Hon. Fredrick D.R. Sampson 1/8/04. Elevator misleveling case. Defendant’s verdict. 12. Custini v.
